People who have been fighting for funding to cover the costs of their nursing help in care homes could face further delays despite today’s announcement of a National Framework for NHS Continuing Healthcare. The social care minister Ivan Lewis said the framework will tackle England’s continuing care funding post code lottery giving thousands more people access to the financial help they need. But community care law specialists martin searle solicitors say the framework may well mean more delays.
“We welcome the move to tackle the unfairness in the system and ensure all people are treated equally when having their needs assessed, regardless of the nature of their healthcare needs and where they live. However, many more people will and should be encouraged to challenge continuing care funding decisions. With an appeals system that is already overstretched, that can only mean longer waits for final decisions. People are already waiting up to twelve months for their cases to be reconsidered and the tragedy is that, in some cases, the most vulnerable people die before a decision is made,” explains community care law advice solicitor Cate Searle of martin searle solicitors.
