For example, we recently secured a reference together with agreed compensation for an employee in an unfair dismissal claim. As Employment Tribunals do not have the power to order an employer to give a reference, this was a good result for our client as she was keen to secure alternative work as soon as possible.
An employer, however, who has acted fairly and is defending an ill-founded Employment Tribunal claim might be advised to continue proceedings rather than agreeing to a settlement, even on a commercial basis, as it could send the wrong message to staff.
