Although it is possible to represent yourself in a UK Employment Tribunal, you are more likely to be successful if you are represented. Tribunal rules of procedure are becoming more complex and losing or winning can depend on using the right tactics from the outset.

At martin searle solicitors we pride ourselves on giving clients practical and sensible advice. Sometimes it is not in a client’s best interests to pursue a case to an Employment Tribunal if the right settlement can be achieved outside of that process. For example, we recently secured a reference together with agreed compensation for an employee in an unfair dismissal case. As Employment Tribunals do not have the power to order an employer to give a reference, this was a good result for our client as she was keen to secure alternative work as soon as possible.
An employer, however, who has acted fairly and is defending a speculative claim might well be advised to continue proceedings rather than agreeing to a settlement, even on a commercial basis, as it could send out the wrong message to remaining staff.
