Martin Searle Solicitors’ Community Care Law team have a busy caseload of mental capacity and Court of Protection (CoP) litigated matters. We are committed to promoting access to justice for our clients and their families in cases that impact their fundamental human rights and best interests. This includes disputes about where the person lacking capacity should live and be cared for; and that person’s contact with others.

We are looking for a solicitor, in-house counsel, legal executive or case worker, who has a strong track record of acting for clients in contested CoP Health and Welfare matters, or other CoP litigation. This includes serious medical treatment; removal of a Deputy or Attorney and cases about financial abuse. You should have experience of running your own complex caseload, including advocacy at Case Management and Directions Hearings.

Our ideal candidate will also have good knowledge of the underlying community care law issues relevant to COP welfare issues, including challenging health and social services in relation to commissioning and funding adequate care packages.  You need to be a good communicator and team player who is committed to providing a high-quality service to all of our clients.

Our Community Care Law Team has a national reputation for its expertise and outcomes, working with lay clients and professional clients. The Head of the team is Cate Searle and the Lead for our Professional Deputy Service is our Mental Capacity expert Paula Jones, both of whom are recognised as leading individuals in the Legal 500:
